Avenrow Labs, LLC ("Avenrow Labs", "Company", "we", "us", or "our") respects intellectual property rights and expects users of our websites, applications, software products, tools, APIs, dashboards, interfaces, and related services (collectively, the "Services") to do the same.
This policy explains how rights owners may contact us about copyright, trademark, or other intellectual property concerns. The contact information below is provided for rights-related communications. We may update this policy if a statutory agent designation is made in the future.
1. REPORTING COPYRIGHT OR IP CONCERNS
If you believe that material available through the Services infringes a copyright, trademark, or other intellectual property right, send a written notice to legal@avenrowlabs.com that includes:
- (a) your physical or electronic signature;
- (b) identification of the copyrighted work, trademark, or other intellectual property right that you claim has been infringed;
- (c) identification of the material that you claim is infringing and sufficient information to allow us to locate it;
- (d) your name, mailing address, telephone number, and email address;
- (e) a statement that you have a good faith belief that the disputed use is not authorized by the rights owner, its agent, or the law;
- (f) a statement that the information in your notice is accurate; and
- (g) if your notice concerns copyright, a statement under penalty of perjury that you are the copyright owner or are authorized to act on behalf of the copyright owner.
2. REVIEW AND ACTION
After receiving a notice, we may remove or disable access to material, contact the user who provided the material, request additional information, decline to act, or take other action we consider appropriate. We may terminate accounts of users who repeatedly infringe intellectual property rights.
3. COUNTER-NOTICES
If material you provided was removed or disabled and you believe it was removed or disabled by mistake or misidentification, you may send a written counter-notice to legal@avenrowlabs.com that includes:
- (a) your physical or electronic signature;
- (b) identification of the material that was removed or disabled and where it appeared before removal or disablement;
- (c) your name, mailing address, telephone number, and email address;
- (d) a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification; and
- (e) a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, the federal courts located in Delaware, and that you will accept service of process from the person who submitted the original notice or that person's agent.
4. FALSE OR MISLEADING NOTICES
Knowingly submitting false, misleading, or abusive notices or counter-notices may expose the submitting party to liability for damages, costs, and attorneys' fees under applicable law.
